Terms & Conditions
Registered & Governed in: Republic of Uganda
These Terms & Conditions (“Terms”) form a legally binding agreement between the client (“You”, “Traveller”, “Guest”) and
Miana Tours & Travel Ltd (“Miana Tours”, “Company”, “We”, “Us”). By booking any safari, tour, accommodation, transportation, activity, or related service with Miana Tours, you expressly agree to be bound by these Terms.
1. Booking, Deposits & Payments
1.1 Deposit Requirement
A non-refundable deposit of **30% – 50%** (depending on destination) is required to confirm your reservation. No booking is considered valid until payment is received and written confirmation is issued by Miana Tours.
1.2 Payment Methods
Payments may be made via bank transfer, mobile money, online payment gateways, or any method communicated directly by Miana Tours.
1.3 Full Payment Deadline
Full payment is required **60 days before the start date**. For last-minute bookings, full payment is required immediately.
1.4 Non-Refundable Government Fees
All gorilla permits, chimpanzee permits, park entry fees, visa fees, and airline tickets are strictly non-refundable once booked.
2. Cancellations & Refunds
2.1 Client-Cancelled Tours
Refunds follow the schedule below (excluding non-refundable items):
- More than 90 days: refund 50% of total tour cost
- 60–90 days: refund 25% of total tour cost
- Less than 60 days: no refund
2.2 No-Shows
No refunds apply for late arrival, unused services, or failure to appear for the tour.
2.3 Company-Cancelled Tours
If Miana Tours cancels a tour for reasons within its control, guests will receive a full refund limited to the payments received.
This does not apply to force majeure events.
3. Travel Documents, Visas & Medical Requirements
You are solely responsible for ensuring possession of:
- A valid passport (minimum 6-month validity)
- All necessary visas for Uganda, Kenya, Tanzania, Rwanda, DR Congo, Burundi, and Congo-Brazzaville
- Yellow fever certificate & required vaccinations
- Travel insurance covering medical evacuation
4. Assumption of Risk & Medical Fitness
Safaris and adventure travel in East & Central Africa involve certain inherent risks, including but not limited to:
- Wild animals & dangerous terrain
- Long driving distances & off-road conditions
- Security risks in remote or politically sensitive areas
- Variable weather conditions
- Exposure to insects, wildlife, and natural environments
By booking with Miana Tours, you voluntarily assume all such risks. You confirm that you are medically fit to travel.
5. Third-Party Suppliers & Cross-Border Operations
Miana Tours works with government wildlife authorities, airlines, hotels, lodges, transportation companies, and local partners in:
Uganda, Kenya, Tanzania, Rwanda, DR Congo, Congo-Brazzaville, Burundi
As these suppliers are independent entities, Miana Tours shall not be held liable for delays, cancellations, operational challenges, or changes imposed by third parties or foreign governments. We reserve the right to substitute accommodations or change itineraries as required for safety or operational reasons.
6. Limitation of Liability (Maximum Protection)
Your sole and exclusive remedy against Miana Tours is strictly limited to the total amount you paid for the safari.
Miana Tours shall not be liable for:
- Indirect, consequential, or incidental damages
- Loss of enjoyment, stress, or inconvenience
- Accidents, illness, or injury during the tour
- Loss or damage to luggage, equipment, or personal property
- Acts of wildlife, nature, or other environmental factors
7. Photography, Video & Media Rights (Option A – Full Rights)
By participating in a Miana Tours safari, you grant the Company an irrevocable, worldwide, royalty-free license to use any photographs, videos, or audio recordings taken during your trip for:
- Marketing & advertising
- Social media & promotional campaigns
- Documentaries & publications
You waive all rights to compensation or approval.
8. Force Majeure
Miana Tours is not liable for delays, cancellations, or losses caused by circumstances beyond its control, including but not limited to:
- Weather, natural disasters, floods, or volcanic activity
- Political unrest, border closures, or government actions
- Epidemics, pandemics, or health emergencies
- Strikes or third-party operational failures
9. Traveller Conduct
Miana Tours reserves the right to remove any traveller from a tour without refund if their behaviour:
- Endangers others
- Violates park or conservation rules
- Is offensive, unlawful, or disruptive
10. Governing Law & Jurisdiction
All bookings are governed exclusively by the laws of the Republic of Uganda.
Any dispute shall be resolved by binding arbitration in Kampala, Uganda.
No other country’s laws or courts shall apply, regardless of where the services were rendered.
